Electrical safety tests in Scotland’s PRS

The legal requirement to have electrical safety tests in Scotland’s private rental sector have only been in place since 2015.  There are two required test certificates- the EICR and PAT. 

The requirement for an Electrical Installation Condition Report (EICR)[1] came into law via The Housing (Scotland) Act 2014 and became statutory regulation from the 1st of December 2015 for new tenancies, and from 1st of December 2016 for existing tenancies.

At the same time Portable Appliance Testing was recognised as a regular requirement for private rented homes. Previously PAT inspections were carried out under a general duty of care to the tenant, however the EICR regulations and Scottish Model PRT lease make PAT certificates a tenancy requirement.
